Sentencing guidelines

Designed to help the criminal justice system operate more efficiently, sentencing guidelines assist judges in penalizing offenders. Knowledgeable attorneys at a criminal law firm in Chicago can explain that there are 43 different offense levels and four sentencing zones for federal criminal convictions.

Below is a list of the four zones and the length of prison time associated with each:

  • Zone A: With no prior history, offense levels one through eight fall under zone A and carry up to six months in prison.
  • Zone B: Zone B covers offense levels 9 and 10 and results in prison time of no more than 12 months.
  • Zone C: Covering offense levels 11 and 12, zone C offenders may not receive more than 16 months in prison. Contact an experienced Chicago criminal law firm if you are charged with committing a zone C offense.
  • Zone D: Crimes that fall under zone D are considered especially serious. Offense levels 13 through 43 fall under zone D, and they are punishable anywhere from twelve months to life in prison.

The U.S. Sentencing Guidelines use two factors to help determine how an offender should be punished. First, the conduct associated with the offense is considered. Especially heinous crimes are dealt with more harshly by the criminal justice system.

Additionally, the criminal history of the defendant is considered. Prior offenses can lead to more serious punishment. For example, if you commit an offense that would normally fall under zone B, you may receive zone C punishment if you have two or three prior convictions. However, an experienced Chicago criminal law firm can build a strong defense to help you fight the charges.
